This product is not affiliated with, endorsed by, or sponsored by any game developers or publishers. All game-related marks are trademarks of their respective owners.

These Terms of Service (“Terms”) govern your access to and use of StaleMatch’s website, applications, and related services (collectively, the “Service”). By creating an account, starting a trial, subscribing, or otherwise using the Service, you agree to these Terms.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and “you” includes that organization.

1) Using the Service

You may access and use the Service only if you agree to these Terms and you comply with all applicable laws and regulations. You must use the Service in a lawful, responsible manner and only for its intended purpose.

You agree not to:

  • misuse the Service or attempt to access it using methods other than the interface and instructions we provide;
  • probe, scan, or test the vulnerability of any system or network connected to the Service;
  • bypass or attempt to bypass security, rate limits, access controls, or authentication measures;
  • interfere with or disrupt the Service (including by introducing malware, automated attacks, or excessive requests); or
  • use the Service to violate the rights of others, including intellectual property, privacy, or contractual rights.

We may restrict, suspend, or terminate access to the Service (in whole or in part) if we reasonably believe: (i) you have violated these Terms, (ii) your use creates risk or legal exposure for us or others, or (iii) it is necessary to protect the security, integrity, or availability of the Service.

The Service may change over time. We may add, modify, or remove features at any time.

2) Game IP and Third-Party Content

The Service may allow you to process, view, label, or organize content that originates from third parties (for example: interfaces, screenshots, map names, match data, logos, or other assets) (“Third-Party Content”). Third-Party Content is owned by its respective rights holders and is protected by intellectual property and other laws.

StaleMatch is not affiliated with, endorsed by, sponsored by, or otherwise associated with any third-party publisher or brand unless we expressly state so in writing. Any references to third-party names or identifiers within the Service are used for identification and informational purposes only.

You are solely responsible for ensuring that your use of the Service in connection with any Third-Party Content complies with:

  • the relevant rights holders’ terms, policies, and rules (including end-user license agreements and community guidelines);
  • any applicable licenses or permissions required to upload, process, or display such content; and
  • applicable law.

We do not grant you any rights in Third-Party Content. Nothing in these Terms authorizes you to use third-party intellectual property beyond what you already have the legal right to use. We may remove, disable, restrict, or modify any Third-Party Content, references, integrations, or features at any time.

3) User Screenshots and Uploads

The Service may allow you to upload content (including screenshots and images) and/or authorize ingestion of content from third-party platforms (including via Discord) (collectively, “Uploads”). Uploads may contain personal data, usernames, or third-party intellectual property.

Your responsibilities. By uploading content or enabling ingestion, you represent and warrant that:

  • you have all rights, permissions, and authority necessary to provide the Uploads to us for the purposes described in these Terms;
  • your Uploads and your use of the Service do not violate any applicable law, contractual obligation, or third-party policy (including game or platform terms); and
  • you will not upload content that is unlawful, infringing, malicious, or that you do not have the right to share.

Limited license to operate the Service. You retain ownership of your Uploads. You grant StaleMatch a limited, non-exclusive, worldwide, royalty-free license to:

  • host and store your Uploads,
  • process your Uploads (including OCR and related analysis),
  • display your Uploads and derived outputs to you within your account, and
  • create and store derived data (for example: extracted text, structured statistics, and confidence scores),

solely as necessary to provide the features you request, operate and secure the Service, prevent abuse, and comply with legal obligations.

No public distribution by default. We do not publicly display or distribute your Uploads unless you explicitly use a feature that is clearly labeled as sharing or publishing.

No training on Uploads without explicit opt-in. We will not use your Uploads to train or fine-tune models, or to create public datasets, unless you explicitly opt in through a separate, clearly presented consent mechanism.

Retention. We retain Uploads only for as long as reasonably necessary for the purposes above. We may delete Uploads after processing and retain only derived outputs and metadata where appropriate.

4) Takedown / Copyright and Trademark Complaints

We respect intellectual property rights and expect users to do the same. If you believe that content available through the Service infringes your copyright or trademark, you may submit a notice to us and we will review it.

How to submit a complaint. Send an email to contact@stalematch.com with the subject line “IP Notice” and include all of the following:

  • Your contact information: full legal name, organization (if any), email address, phone number, and mailing address.
  • Identification of the rights you own: description of the copyrighted work or trademark you claim is being infringed, and evidence of ownership or authorization.
  • Identification of the allegedly infringing material: specific URL(s) within the Service where the material can be found.
  • Good-faith statement: statement that you have a good-faith belief the use is not authorized.
  • Accuracy and authority statement: statement that the information is accurate and that you are the rights holder or authorized to act.
  • Signature: physical or electronic signature.

5) Disclaimers and Limitation of Liability

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, StaleMatch and its affiliates, officers, employees, agents, and suppliers disclaim all warranties and conditions, whether express, implied, or statutory.

We do not warrant that:

  • the Service will be uninterrupted, timely, secure, or error-free;
  • OCR, extraction, analytics, or other outputs will be accurate, complete, or reliable; or
  • any defects will be corrected.

You acknowledge that outputs generated by OCR or other automated processing may contain errors and should be reviewed before being relied upon for any purpose.

Availability Disclaimer. We do not guarantee any specific uptime, competitive outcomes, rankings, or performance results from use of the Service.

Limitation of liability. To the maximum extent permitted by applicable law: StaleMatch will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages. StaleMatch’s total liability for any claim arising out of or relating to the Service will not exceed the amount you paid to StaleMatch for the Service during the three (3) months immediately preceding the event (or USD $50).

10) Third-Party Services and Links

The Service may integrate with, rely on, or link to third-party services (for example: Discord, hosting providers, analytics, or payment processors). We do not control third-party services and are not responsible for their availability, security, performance, or content.

15) Miscellaneous

If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full force and effect. You may not assign these Terms without our prior written consent.

These Terms (together with any policies or pages expressly referenced by the Service) constitute the entire agreement between you and us regarding the Service.
